This Privacy Policy describes how Blackshark.ai collects, uses, and shares your personal data. We strongly believe in your fundamental right to privacy, and we stand by the principle of giving you in control of how we may use your personal data. We define personal data as any data that can be used to uniquely identify a natural person. This Privacy Policy covers how Blackshark.ai GmbH and affiliated companies (collectively, “Blackshark”) handle personal data.

Section 1 - Your Privacy Rights

At Blackshark, we respect your ability to know, access, correct, transfer, restrict the processing of, and delete your personal data. Blackshark does not sell your data including as “sale” is defined in Nevada and California.

There may be situations where we cannot grant your request — for example, if you ask us to delete your transaction data and Blackshark is legally obligated to keep a record of that transaction to comply with law. We may also decline to grant a request where doing so would undermine our legitimate use of data for anti-fraud and security purposes, such as when you request deletion of an account that is being investigated for security concerns. Other reasons your privacy request may be denied are if it jeopardizes the privacy of others, is frivolous or vexatious, or would be extremely impractical.

Section 2 - Personal Data Blackshark Collects

We strive to collect only the personal data we need to provide you with our products and services.

When you use Blackshark.ai ORCA containers or modules via the Marketplace, connect to our services, contact us, or otherwise interact with Blackshark, we may collect a variety of information including:

  • Account information: your tenant ID and email address.

  • Contact information: your email address, physical business address, phone number or other contact information.

  • Payment information: data about your billing address and method of payment, such as bank details, credit, debit, or other payment card information.

  • Transaction information: data about purchases of Blackshark products and services.

  • Fraud prevention information: data used to help identify and prevent fraud.

  • Usage information: Data about the usage of our offerings, including launches, error and execution logs, performance data, crash, and other diagnostic data.

  • Other information you provide us: details such as your communications with Blackshark, including interactions with customer support and contacts through our inquiries email inbox.

Section 3 - Personal Data Blackshark Receives from Other Sources

Blackshark may receive information about you from platform and marketplace providers or from Blackshark partners who work with us in marketing or selling our products and services. These third parties are acting at your direction when sharing data with Blackshark and may provide us information such as:

  • Platform or Marketplace user ID or tenant ID on which you are deploying Blackshark products.

  • Information about virtual machines or other cloud resources associated with your account / tenant on which you are using Blackshark products.

  • Information about Blackshark products or services you are interested in acquiring and for which you have requested additional information.

Section 4 - Blackshark’s Use of Personal Data

Blackshark uses personal data to process your transactions, to communicate with you, for security and fraud prevention, and to comply with the law. We may also use personal data for other purposes with your consent.

Blackshark uses your personal data only when there is a valid legal basis to do so. We may rely on your consent or the fact that the processing is necessary to fulfill a contract with you, or to comply with legal requirements.

  • Processing your transactions: We collect data such as your name, email address, physical business address, purchase, and payment information to process transactions for Blackshark products and services.

  • Communicate with you: To respond to communications, reach out to you about your transactions, market our products and services, provide other relevant information, or request information or feedback. From time to time we may use personal data to send important notices, such as communications about product purchases or updates to our products, services, policies, or terms and conditions, because this information is important to your interaction with Blackshark, you may not opt out of receiving important notices.

  • Security and fraud prevention: To protect individuals, employees, and Blackshark and for loss prevention and to prevent fraud, misappropriation or unauthorized use of our products and services.

  • Comply with Laws: To comply with applicable laws, for example – to satisfy tax or reporting obligations, export controls and regulations, or lawful government requests.

Blackshark retains personal data only for so long as necessary to fulfill the purposes for which it was collected, including as described in this Privacy Policy, or in product-specific privacy notices, or as required by law.

Section 5 - Blackshark’s Sharing of Personal Data

Blackshark may share your data with Blackshark-affiliated companies, service providers who act on our behalf, or our partners at your direction. Blackshark does not share personal data with third parties for their own marketing purposes.

  • Service providers: Blackshark may engage third parties such as cloud service providers, payment processors, or Blackshark suppliers for the purposes of delivering Blackshark products and services to you. Blackshark service providers are obligated to handle personal data consistent with this Privacy Policy and according to our instructions. They cannot use the personal data we share for their own purposes and must delete or return the personal data once they’ve fulfilled our request.

  • Partners: Blackshark has partners that help deliver products, services, and solutions to meet your needs. We may share contact information to enable our partners to service your requests and work at your direction.

Section 6 - Transfer or Personal Data Between Countries

Blackshark products and services are available worldwide, and to make that possible, your personal data may be transferred or accessed by entities around the world, including Blackshark affiliates or service providers to perform activities consistent with those described in this Privacy Policy, and in connection with your use of our products and services. Blackshark complies with laws on the transfer of personal data between countries to help ensure your data is protected, wherever it may be.

Blackshark’s transfer of personal data collected from individuals in the European Economic Area the United Kingdom, and Switzerland is governed by Standard Contractual Clauses (for more information see https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/standard-contractual-clauses-scc_en).

Section 7 - Our Companywide Commitment to Your Privacy

To make sure your personal data is secure, we communicate our privacy and security guidelines to Blackshark employees and strictly enforce privacy safeguards within the company.
